Distance Sales Contract

2. Subject of the contract

This Contract sets out the rights and obligations of the Parties in connection with the sale, by the Seller to the Buyer through the WelcomeApp mobile application (with the website https://welcomeapp.org as a public information channel), of tour and excursion services organised by licensed Turkish operators.

The essential characteristics, price and total amount of each service are displayed on the corresponding tour screen and on the order summary screen prior to payment.

3. Order and total price

3.1. The Buyer places an order by selecting the tour in the WelcomeApp mobile application, completing the booking form (date, number of travellers, pickup address) and confirming the order on the Checkout screen.

3.2. The total price includes the service price and all applicable taxes (KDV) and fees. Any additional cost (e.g. optional extras at the tour location) will be clearly indicated before the order is placed.

3.3. Payment is made by credit or debit card through the secure payment screen of iyzi Ödeme ve Elektronik Para Hizmetleri A.Ş. (iyzico), with 3-D Secure verification. The Seller does not collect or store full card data. Depending on the option chosen by the Buyer, payment may be 50 % at booking with the balance due on the tour day, or 100 % online at booking.

4. Performance of the contract

The Seller (or its licensed local partner) will perform the tour on the date and at the time stated in the booking confirmation. The driver / operator will arrive at the pickup address entered by the Buyer in the app at the agreed time. The Buyer must be at the pickup location at the agreed time, with valid ID where required.

5. Durable medium

This Contract, the Pre-Information Form and the booking confirmation are made available to the Buyer as a durable medium (kalıcı veri saklayıcısı) through the "My Orders" screen of the WelcomeApp mobile application, where the Buyer can access them at any time after purchase. A push notification is sent to the Buyer immediately after a successful payment to confirm that the booking has been recorded.

6. Right of withdrawal — important

Tours and excursions are services performed on a specified date or in a specified period of time. They fall within the exception in Article 15(g) of the Turkish Regulation on Distance Contracts and the Buyer does not have a 14-day right of withdrawal for these services. Cancellation, however, is possible according to the terms of Section 7 below.

7. Cancellation, modification and refunds

The following rules apply, save where the tour screen states more favourable conditions:

  • More than 48 hours before the tour start time: free cancellation, full refund of any amount paid online.
  • Between 48 and 24 hours before the tour start time: 50 % of the tour price is refunded.
  • Less than 24 hours before the tour start time, no-show, or not being present at the pickup address at the agreed time: no refund.

To cancel, the Buyer must send an e-mail to [email protected] stating the order number. The Buyer can find the order number on the "My Orders" screen of the WelcomeApp mobile application. Refunds are processed to the same card used for payment, within up to 14 business days of acceptance, depending on the issuing bank.

If the Seller cancels a tour (e.g. due to weather, safety, force majeure or insufficient participants), the Buyer is entitled to a full refund or, at his/her choice, to rebook for another available date.

8. Defective performance / non-conforming services

If the service does not conform to what was advertised, the Buyer must notify the Seller without undue delay at [email protected], with a description of the issue and, where possible, supporting evidence (photos). The Seller will investigate and, where the complaint is justified, offer re-performance, a partial refund or a full refund as appropriate, in accordance with Law No. 6502.

9. Force majeure

Neither Party is liable for failure to perform caused by circumstances beyond its reasonable control, including natural disasters, government acts, strikes, pandemics, war, terrorism or telecommunications outages. In such cases the Seller will offer a rescheduled date or, where this is not possible, a full refund.

10. Personal data

Personal data are processed in accordance with the Privacy Policy.

11. Disputes — competent authority

For consumer complaints, the Buyer may apply to the Consumer Arbitration Committees (Tüketici Hakem Heyeti) or the Consumer Courts (Tüketici Mahkemeleri) in his/her place of residence, within the monetary limits set every year by the Ministry of Trade.

12. Acceptance

By ticking the box "I have read and accept the Distance Sales Contract" on the Checkout screen of the WelcomeApp app and tapping the "Pay" button, the Buyer confirms that he/she has read and accepted this Contract.
