Terms of Use
1. Your Copy of the Agreement
1.1. This website https://welcomeapp.org and the WelcomeApp mobile application (collectively, the "WelcomeApp Platform") are operated by LEADERHOMES EMLAK İNŞAAT TURİZM VE TİC. LTD. ŞTİ., a company incorporated under the laws of the Republic of Türkiye, trading as TRUE WAYS TRAVEL AGENCY (TÜRSAB licence A-17771), with its registered office at Kızlar Pınarı Mah., Kızlar Pınarı Cad., İlçi Apt. No:70/A, Alanya / Antalya, Türkiye. Please carefully read these Terms of Use (the "Terms of Use") before using the WelcomeApp Platform and the services offered by LEADERHOMES EMLAK İNŞAAT TURİZM VE TİC. LTD. ŞTİ., its subsidiaries (collectively, "WelcomeApp", "we", "our", "us") or third-party operators (each, an "Operator") through the WelcomeApp Platform (the "Services"). The words "you" and "your" mean (1) any person accessing the WelcomeApp Platform and (2) any person for whom you purchase Services.
1.2. These Terms of Use govern your use of the WelcomeApp Platform and your relationship with WelcomeApp. The actual purchase of Services is governed by a separate Distance Sales Contract (Mesafeli Satış Sözleşmesi), accepted by you on the Checkout screen at the time of booking. In case of any conflict between these Terms of Use and the Distance Sales Contract regarding the purchase of Services, the Distance Sales Contract prevails.
2. Changes to the Terms of Use
2.1. Changes Made by WelcomeApp
2.1.1. WelcomeApp reserves the right to modify or amend any part of these Terms of Use. We will publish the revised version on the WelcomeApp Platform and update the "Last updated" date at the top of this page. For material changes we will provide reasonable advance notice through an in-app message and / or by e-mail before the changes take effect.
2.1.2. Your continued use of the WelcomeApp Platform after the changes take effect means that you accept the revised Terms of Use. If you do not agree to the revised Terms of Use, you should stop using the WelcomeApp Platform. Changes to these Terms of Use do not retroactively change the terms of any Services you have already purchased — those remain governed by the Distance Sales Contract accepted at the time of purchase.
3. Access and Use of Services
3.1. Ownership of Content
3.1.1. The WelcomeApp Platform, the domain name https://welcomeapp.org, its subdomains, features, informational content and application services (including any mobile application services) periodically offered by WelcomeApp belong to WelcomeApp or are licensed to WelcomeApp by their respective owners.
3.2. Provision and Availability of Services
3.2.1. Subject to these Terms of Use, WelcomeApp may offer Services independently or on behalf of Operators, as further detailed on the WelcomeApp Platform. The Services you choose are intended for your personal use and not for the benefit of any third party. WelcomeApp may modify, suspend or discontinue the provision of any Services at any time, including access to any feature, database or informational content, subject to honouring already-purchased bookings.
3.2.2. WelcomeApp does not guarantee that access to the Services will always be uninterrupted. WelcomeApp is not responsible if, for technical reasons beyond our reasonable control, the Services are temporarily unavailable. You are responsible for taking all necessary measures to gain access to the Services and for ensuring that any persons accessing the Services on your behalf comply with these Terms of Use.
3.2.3. Linking to the WelcomeApp Platform from another website or application requires our prior written consent. WelcomeApp reserves the right to revoke any such consent at any time.
4. WelcomeApp Platform and Content
4.1. Use of Content
4.1.1. All materials displayed or used on the WelcomeApp Platform — including text, data, graphics, articles, photographs, images, illustrations, videos and audio (collectively, "Content") — are protected by copyright and / or other intellectual property rights. The WelcomeApp Platform and Content are intended solely for your personal and non-commercial use of the Services and may only be used in accordance with these Terms of Use.
4.1.2. WelcomeApp grants you a non-exclusive, non-transferable, limited licence to access the WelcomeApp Platform under these Terms of Use. WelcomeApp may, at its sole discretion and at any time, modify, remove or alter the presentation, content or functionality of all or part of the Content on the WelcomeApp Platform.
4.1.3. You must comply with all copyright notices, trademark instructions and restrictions contained on the WelcomeApp Platform. You may not use, copy, reproduce, modify, translate, publish, transmit, distribute, display, license or sell any part of the WelcomeApp Platform, the Content or any third-party materials without the explicit prior written consent of the relevant owners.
4.2. WelcomeApp's Responsibility Regarding the WelcomeApp Platform and Content
4.2.1. WelcomeApp does not verify the identity of every other user with whom you may interact while using the WelcomeApp Platform. WelcomeApp does not guarantee the authenticity or accuracy of any informational content provided by other users or by Operators.
4.2.2. To the extent permitted by applicable law, and subject to Section 12.4 below, WelcomeApp is not liable for errors or omissions in any Content posted, sent, used or otherwise made available through the WelcomeApp Platform by other users or Operators.
5. Intellectual Property Rights
5.1. Intellectual Property
5.1.1. All intellectual property rights related to the WelcomeApp Platform belong to WelcomeApp or have been licensed to WelcomeApp. The WelcomeApp Platform, the Services and the Content are protected by copyright and other intellectual property laws.
You agree to the following:
(a) you are not permitted to modify, publish, transmit, transfer, sell, reproduce, create derivative works from, distribute, perform, display or otherwise use any part of the WelcomeApp Platform, the Content, the underlying software, or the Services, except as expressly permitted by these Terms of Use;
(b) you may download or copy Content only for personal and non-commercial use, provided that you retain all copyright notices contained in such Content;
(c) you must not store any substantial portion of any Content. Copying or storing Content for purposes other than personal and non-commercial use is prohibited without prior written permission from WelcomeApp or the relevant copyright owner.
6. User Materials
6.1. Information Upload
6.1.1. When using the WelcomeApp Platform you may provide information that may be used by WelcomeApp and / or Operators in connection with the provision of Services and may, in some cases, be visible to other users. By posting or otherwise providing content, materials or information to WelcomeApp or to Operators (collectively, "User Materials") you acknowledge and agree that:
(a) you grant WelcomeApp and Operators a non-exclusive, worldwide, royalty-free, sublicensable and transferable right to use such User Materials in connection with the provision of Services and the operation of the WelcomeApp Platform, including for the purpose of promoting and distributing the Services;
(b) you authorise WelcomeApp to process your personal data in accordance with the Privacy Policy and the KVKK Notice;
(c) you grant each user of the WelcomeApp Platform a non-exclusive licence to access your User Materials through the WelcomeApp Platform and to use, reproduce, distribute and display them as enabled by the functionalities of the WelcomeApp Platform;
(d) WelcomeApp may reformat, modify, create derivative works from, extract portions of and translate User Materials submitted by you. This does not affect your underlying ownership of the User Materials;
(e) you represent and warrant that the User Materials do not violate any applicable law, regulation or third-party right;
(f) you bear sole responsibility for the User Materials you make available through the WelcomeApp Platform.
7. User Representations, Warranties, and Obligations
7.1. Use of the WelcomeApp Platform and Services
7.1.1. You are responsible for all of your activity in connection with the WelcomeApp Platform and the Services. You represent, warrant and undertake to WelcomeApp that you will not:
(a) engage in any fraudulent, abusive or otherwise illegal activity that may result in the termination of your right to access or use the WelcomeApp Platform and / or Services;
(b) post or transmit any message or request intended to obtain a password, account or private information from any other user of the WelcomeApp Platform;
(c) compromise the security of any computer network, attempt to obtain passwords or encryption keys, or transmit or store illegal materials, including materials that are threatening, defamatory or obscene;
(d) use mailing lists, mass e-mailing, auto-responders or any other form of spam, or interfere with the proper operation of the WelcomeApp Platform or place an excessive load on its infrastructure;
(e) use manual or automated software, devices or other processes to scrape, crawl or otherwise bypass any page of the WelcomeApp Platform;
(f) decompile, reverse engineer or otherwise attempt to obtain the source code of the WelcomeApp Platform.
8. Registration and Security
8.1. Creating a WelcomeApp Account
8.1.1. To use most of the Services you need to create a WelcomeApp account (a "WelcomeApp Account") using your e-mail address and a password.
8.2. Providing Personal Information
8.2.1. You are required to provide a valid e-mail address and to set a secure password. The combination of your e-mail and password is your "WelcomeApp User Identifier".
8.2.2. You must provide WelcomeApp with accurate, complete and up-to-date registration information. Failure to do so is a breach of these Terms of Use and may result in suspension or termination of your WelcomeApp Account.
8.2.3. You will not:
(a) register or use a name or e-mail address that belongs to another person with the intent to impersonate that person;
(b) register on behalf of someone else without proper authorisation.
8.2.4. WelcomeApp reserves the right to refuse registration or to suspend a WelcomeApp Account if there is reasonable evidence of fraud, abuse or breach of these Terms of Use. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your WelcomeApp Account. You can delete your WelcomeApp Account at any time from the Settings screen of the mobile application or by writing to [email protected].
9. In-App Notifications, Reviews and Communications
9.1. By making a booking you agree to receive booking-related notifications (in the form of in-app push notifications and, where applicable, e-mails), as well as invitations to share your feedback after participating in a tour.
9.2. Content provided by you in reviews or feedback will be considered non-confidential. WelcomeApp is not obligated to treat such content as confidential. WelcomeApp may, at its discretion, publish, edit, modify, reject or remove any user-submitted content. WelcomeApp is not obligated to compensate you for the content you provide or to ensure attribution by third parties.

10. Booking, Vouchers, Fees and Payment
10.1. Booking Confirmation
10.1.1. Most Services on the WelcomeApp Platform are subject to instant confirmation. After successful payment, the booking appears on the "My Orders" screen of the WelcomeApp mobile application and a push notification is sent to your device. The "My Orders" screen acts as the durable medium (kalıcı veri saklayıcısı) for your booking, the Distance Sales Contract and the Pre-Information Form, all of which remain accessible there for your records.
10.2. Vouchers and Confirmation Number
10.2.1. Each booking generates a unique confirmation number (the "Confirmation Number"), visible on the "My Orders" screen. The Confirmation Number, together with the booking details, acts as your voucher for the Service.
10.2.2. To use the Service you must be at the pickup address you entered when booking, at the agreed date and time. If you fail to be present at the agreed pickup point, the rules in Section 10.4 below apply.
10.2.3. Where required by the Service or by law (for example, where the Service is subject to age restrictions or requires identity verification), the Operator may ask you to present a valid photo ID. WelcomeApp and the Operator are not responsible for inability to perform a Service caused by your failure to present required identification, except where the Operator's request is unlawful.
10.3. Voucher Usage Terms
10.3.1. The terms of use for each booking may vary depending on the Operator. Any restrictions applicable to a Service, including minimum age requirements or accessibility limitations, are communicated to you on the tour screen at the time of booking.
10.3.2. Bookings grant you access to the Service on the specified date and time. If you do not use the booking on the date specified, the cancellation rules in Section 10.4 below and in the Refund Policy apply.
10.4. Cancellation and Refunds
10.4.1. Cancellation by you. You can request cancellation by sending an e-mail to [email protected], stating the Confirmation Number from your "My Orders" screen. The amount refunded depends on how far in advance you cancel:

10.4.2. Cancellation by us / by the Operator. If WelcomeApp or the Operator cancels a Service (for example, due to weather, safety, force majeure or insufficient participants), you receive a full refund to the same payment method, or you may rebook free of charge for another available date.
10.4.3. Refund processing. Approved refunds are issued to the same card used for the original payment, via our payment service provider, within up to 14 business days of acceptance. The exact arrival time depends on your issuing bank.
10.4.4. Defective performance. If the Service does not conform to what was advertised, please contact us at [email protected] without undue delay. We will investigate and, where the complaint is justified, offer re-performance, a partial refund or a full refund as appropriate, in accordance with Turkish Consumer Protection Law No. 6502. Nothing in these Terms of Use limits your statutory rights as a consumer.
10.5. How to Request Assistance
10.5.1. If you have a question or complaint about a Service please write to [email protected]. WelcomeApp will reply within 2 business days and, where appropriate, contact the Operator on your behalf.
10.6. Fees
10.6.1. The price of each Service, including all applicable taxes (KDV) and fees, is shown on the order summary screen before you confirm payment. No additional fees are charged unless explicitly indicated on that screen.
10.7. Pricing Changes
10.7.1. WelcomeApp reserves the right to change the prices of Services at any time. Price changes do not affect Services already booked and paid for — those remain at the price you accepted at the time of booking.
10.8. WelcomeApp Rights and Responsibilities
10.8.1. WelcomeApp may refuse or cancel any booking deemed to be in violation of these Terms of Use (for example, fraudulent transactions). In such cases the amount paid is fully refunded.
10.8.2. WelcomeApp aims to offer competitive prices but does not guarantee that the price displayed is always the lowest available on the market.
10.8.3. Operators are required to provide WelcomeApp with accurate and up-to-date pricing. If a price displayed on the WelcomeApp Platform turns out to be obviously incorrect (for example, due to a technical error), WelcomeApp may, before confirming the booking, contact you to confirm the correct price or to cancel the booking with a full refund.
10.9. Global Applicability
10.9.1. The cancellation and refund rules above apply to all WelcomeApp users worldwide. They are without prejudice to mandatory consumer-protection rules of the country in which you reside, where these grant you additional or stronger rights.
11. Indemnification and Liability Release
11.1. Indemnification of WelcomeApp
11.1.1. To the extent permitted by applicable law, you agree to indemnify and hold harmless WelcomeApp, its parent companies, subsidiaries, affiliates, officers, directors and employees from any losses, liabilities, settlements, costs, attorneys' fees, claims or demands arising from your breach of these Terms of Use or from your infringement of any intellectual property or other rights of any third party. This indemnity does not apply to claims that result from WelcomeApp's own negligence or wilful misconduct, and it does not limit your statutory rights as a consumer.
11.2. WelcomeApp's Involvement in Legal Defence
11.2.1. WelcomeApp may, at its discretion, participate in the defence of any claim or in settlement negotiations relating to a matter in which it is involved. You may not enter into any settlement that materially affects the rights or obligations of WelcomeApp without our prior written consent. WelcomeApp reserves the right, at its own expense, to assume the exclusive defence and control of any such claim.
12. Disclaimer of Warranties and Limitation of Liability
12.1. Relationship Between the Parties
12.1.1. WelcomeApp does not establish a special or fiduciary relationship with you regarding access to and use of the WelcomeApp Platform and the Content.
12.2. Services and Recommendations
12.2.1. Operators may offer Services on the WelcomeApp Platform, and other users or Operators may post suggestions or recommendations. WelcomeApp does not guarantee the accuracy of any Service description provided by an Operator or the validity of any user recommendation.
12.3. Disclaimer
12.3.1. The WelcomeApp Platform, including all software, features, materials and information available on or accessed through the WelcomeApp Platform, is provided "as is" and "as available". To the fullest extent permitted by law, WelcomeApp makes no warranties, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy of information or uninterrupted operation of the Services.
12.4. Limitation of Liability
12.4.1. For consumers in Türkiye and the European Economic Area: nothing in these Terms of Use excludes or limits WelcomeApp's liability for (i) death or personal injury caused by our negligence, (ii) gross negligence or wilful misconduct, (iii) fraud, or (iv) any other liability that cannot be excluded or limited under applicable mandatory law (in particular Turkish Consumer Protection Law No. 6502).
12.4.2. Subject to Section 12.4.1, WelcomeApp's total aggregate liability arising out of or in connection with these Terms of Use, the WelcomeApp Platform or any Service is limited to the amount you paid to WelcomeApp for the Service that gave rise to the claim, plus, where applicable, additional damages directly and reasonably foreseeable as a result of our breach.
12.4.3. WelcomeApp will not be liable for indirect or consequential damages, including loss of profit, loss of business or loss of opportunity, except where such liability cannot be excluded under applicable mandatory law.
12.5. Legal Remedies
12.5.1. If you are dissatisfied with the WelcomeApp Platform or any Service, please first contact us at [email protected] so that we can try to resolve the matter. If the matter is not resolved, you retain all rights available to you under applicable law, including the right to apply to the Consumer Arbitration Committees (Tüketici Hakem Heyeti) or Consumer Courts (Tüketici Mahkemeleri) in your place of residence.
13. Interaction with Third Parties
13.1. Third-Party Links
13.1.1. The WelcomeApp Platform may contain links to third-party websites or services ("Third-Party Sites") that are not owned or controlled by WelcomeApp. The presence of a link does not imply endorsement of the third-party website or service.
13.1.2. Accessing Third-Party Sites is at your own risk. You are responsible for reading and accepting any applicable terms of those third parties.
13.1.3. WelcomeApp does not control and is not responsible for the content, privacy practices or policies of any Third-Party Site.
13.1.4. Your dealings with any third parties contacted through the WelcomeApp Platform — including any payment, delivery, warranty or representation — are solely between you and those third parties.
13.1.5. We recommend that you carry out any investigation you deem appropriate before entering into transactions with third parties identified through the WelcomeApp Platform.
13.2. WelcomeApp's Liability for Third-Party Interactions
13.2.1. To the extent permitted by applicable law, WelcomeApp is not responsible for losses or damages incurred as a result of transactions between you and third parties identified through the WelcomeApp Platform. If a dispute arises between you and another user or third party, WelcomeApp is not obligated to become involved, but may do so at its discretion. This Section 13.2 does not limit your statutory rights against WelcomeApp where WelcomeApp itself is the seller or service provider.
14. Termination of Access
14.1. Termination by WelcomeApp
14.1.1. These Terms of Use remain in effect while you use the WelcomeApp Platform or the Services. WelcomeApp may terminate or suspend your access to the Services or to your WelcomeApp Account if you breach these Terms of Use, with reasonable advance notice where the breach is capable of being remedied, or without notice in cases of fraud, security risk or illegal activity.
14.2. Consequences of Termination
14.2.1. On termination of your WelcomeApp Account, your right to use the Services and to access the WelcomeApp Platform ceases. The provisions of these Terms of Use that, by their nature, should survive termination — including provisions on intellectual property, disclaimers, limitations of liability and dispute resolution — remain in effect.
14.2.2. Termination of your WelcomeApp Account does not automatically cancel paid bookings that have not yet been performed. Any such bookings remain governed by their Distance Sales Contract and the Refund Policy. If WelcomeApp terminates your account in circumstances where the booking can no longer reasonably be performed, the unused portion of the price is refunded to the original payment method.
15. Miscellaneous Provisions
15.1. Severability
15.1.1. If any provision of these Terms of Use is held to be unenforceable or invalid, that provision will be modified or removed to the minimum extent necessary, and the remaining Terms of Use will remain in full force and effect.
15.2. Assignment
15.2.1. You may not assign or transfer these Terms of Use without our prior written consent. WelcomeApp may assign or transfer these Terms of Use, including any rights and obligations, to an affiliate or in connection with a corporate reorganisation, with prior notice and without affecting your rights as a consumer.
15.3. Language
15.3.1. These Terms of Use are originally drafted in English. A Turkish translation is provided for the convenience of Turkish users and, for consumer relationships in Türkiye, the Turkish version is the binding one to the extent required by Turkish Consumer Protection Law No. 6502. For all other users, the English version is the binding one. Any other translation is provided for informational purposes only.
15.4. Governing Law and Jurisdiction
15.4.1. These Terms of Use are governed by the laws of the Republic of Türkiye. The competent courts and consumer-protection authorities of the Republic of Türkiye have jurisdiction over any dispute arising out of or in connection with these Terms of Use, without prejudice to mandatory consumer-protection rules of your country of residence.

In case of any conflict between these Terms of Use and the Distance Sales Contract regarding a specific Service, the Distance Sales Contract prevails. In case of any conflict between these Terms of Use and a mandatory provision of Turkish Consumer Protection Law No. 6502, the mandatory provision prevails.
